On his appeal in January 2013 Palanisami was sentenced by the Additional Sessions Judge of Tiruvallur Court on 30th March 2015 again to undergo 2 years Rigorous Imprisonment and to pay a fine.

Local people are telling, that Muralidharan himself is a sexmania. For him it is not enough to force women to have sex with him. Together with Kingston (the present 'Head of Kasuva') and Chittibabu (former Headmaster, now teaching in a Government School) Muralidharan formed the holy trinity of group-sex having Kingston even as his homosexual partner. By bringing also prostitutes in the night to Sevalaya guesthouse they produced their own pornographic movies watching them in the night.It is said that many teachers already left because of his sex harassment. They and others still keep quiet because they have to send their children to Sevalaya School. And his sexual head-mistress became now the headmistress of the school, another mistress a trustee! Because of his sexmania with other women his father in law had a big fight with him on the campus. They say that Muralidharan threatened him to kill him. Finally his father in law bowed his head because of his daughter, what made him extremely depressed. Even Muralidharan's wife, they say, is thinking of divorce.
The only person, who had the courage to stand up and open the Pandora box, was the then 13 year-old girl Durga. She was sexually abused by a Sevalaya teacher, who was completely backed by Muralidharan. Durga still has to wait for final justice inspite of a very clear judgment of Thiruvallur Court in Dec. 2012. Since then, after the appeal of the teacher, the case has not moved forward even 1 centimeter, inspite of pending at the Fast Track Court! People -well versed in Criminal Law and Judiciary- say, that this delay of nearly 2 years is only possible by using a lot of money, which the teacher does not have. Sources say that Muralidharan gave it by misusing money, which was given to him for the sake of the children.
The judgment from Dec. 2012 highlightened also the negligence of Muralidharan and the management of Sevalaya. Under the present law their behaviour would be punishable.Local people also tell, that Muralidharan was laundering money with the help of politicians (CBI should investigate into all accounts). With his pädophile nature he used Sevalaya children for his political goonies. Many ugly stories are told - but Muralidharan threatened all the victims with the help and power of his political goonies and police.
It is said that Muralidharan is involved in many criminal activities like his elder brother was, who committed suicide. Also Muralidharan could do that one day because he is lacking the courage to face his own rotten behaviour and its consequences. Yet he is pretending, like he did so many times in the past, that people want to kill him. But who shall have an interest to kill

This is a detailed and authentic but not yet complete account of the past 12 years, how co-founder and managing trustee Muralidharan of NGO Sevalaya in Kasuva Village, near Thiruninravur - 602 024 near Chennai, South India,- misled and manipulated Indian Courts and the public including foreign donors
- suppressed the crime of child sexual abuse, which happened in Sevalaya
- threatened and defamed everybody, who wanted justice for the 13-year-old victim of child sexual abuse like German based donor Yoga-Vereinigung Rajagopalan e. V. (YVR), S. Rajagopalan und Jan-Uwe Burmeister, who had supported Sevalaya for 7 years (1998-2005) as one of its major responsible donors giving 52 lakhs Rupees to Sevalaya's children and more than 6 crores Rupees (around 1.2 Million Euro) to Tamil Nadu's children. YVR also sent 7 containers with about 450 well-functioning wheelchairs and a lot of other useful equipment to an institution for spastic children in Chennai.

As a physics teacher in Sevalaya he was convicted on 11.12.2012 for having sexually abused 13-year-old Durga in the physics lab of Sevalaya Mahakavi Bharathiar Higher Secondary School in August 2006.
Sevalaya's Muralidharan is collecting money from Indian and also foreign donors worldwide, projecting to them and the public constantly that Sevalaya is a safe place for everybody, especially girl-children, in which all are loved and served.
Why did he never inform the public and his donors about corporal punishment, child sexual abuse, suicide and death of Sevalaya-children out of carelessness, a murder case in Sevalaya's old age home and other incidents inside Sevalaya?
What is the use of sending worldwide letters, e-mails, the monthly Sevalaya's 4-pages-Newsletter, the annual reports and also being worldwide present on Sevalaya's website, social media like facebook and on YouTube, when his and Sevalaya's other side is never mentioned?
Is it permissible for an institution and its management to suppress information about criminal activities which happened inside it - and even making false allegations against victims and reputed foreign donors?
What is the safeguard to the children depending on such management?
Would Muralidharan/Sevalaya have got the more than 30 AWARDS since 2006, if the real situation would have been known? What a waste of time and money for donors, when the children are not safe?! These and many more other questions are not answered for the past 12 years.
Sevalaya is a registered charitable trust functioning from Kasuva Village in Thiruvallur District since 1988. Sevalaya's aim is to render services to the orphan, poor, destitute children and senior citizens -as Muralidharan states- free of charges without any distinction on the basis of caste/creed/religion/language/gender etc.
Sevalaya's main activities are a home for the orphan, poor and destitute children (around 150 children) and a free recognized, unaided Higher Secondary School educating around 1.700 children, which should come from poor, backward and socially depressed sections. Muralidharan claims that Sevalaya school also won an All India Award by TCS - Educational World Awards Committee - 2006 for innovative and value based education, out of 25.000 schools.
That is not true: the former headmaster Chittibabu won this award, not Sevalaya (see 'Awards', 'Award TCS - Educational FormerWorld').Why is he, the best primary school teacher out of 25.000 schools, no more the headmaster of Sevalaya? Why did he leave Sevalaya after all the trumpet blowing by Muralidharan and where is he now?
When Durga informed Muralidharan, that she was sexually abused by Palanisami inside Sevalaya, he did not show any interest inspite of the known fact that she was suffering from rheumatic heart disease. Instead he warned her not to talk further about the child sexual abuse. Instead of investigating the incident Muralidharan forced Durgha and her witness to the sexual abuse, Miss Adi Lakshmi, and others including some teachers, who wanted justice for Durga, to leave Sevalaya.
But Muralidharan allowed the accused Palanisami to continue to work as a teacher for about 3 more years.
Durga ran from pillar to post to find support for her justice. But even the collector as well as the local Vengal Police Station sent her away without taking her complaint. Also people came to Durga and threatened her in the name of Muralidharan.
A lady teacher in Sevalaya advised Durga to talk to her husband, Mr. Prabhu, who is an advocate. He documented by videotaping Durga's bitter experience of the sexual abuse by Palanisami. He also documented by videotaping several former students, staff and teachers regarding Muralidharan, former headmaster Chittibabu, present headmaster Kingston, asst. head mistress Annapoorna and Tamil department head B. Nirmala about their irresponsible behaviour in Sevalaya.
Among these information gathered was, that a boy student from Sevalaya committed suicide in his school uniform on his way back home because he was threatened by the headmaster Chittibabu.
And one student complained, that Chittibabu hit him with a metal rod on the head and that he was rushed to the hospital in a serious condition. He had many stiches on his head for the injury. That boy, who got hit by Chittibabu by a metal rod, accidently saw one day Chittibabu in the toilet with a lady teacher in a close encounter. Advocate Prabhu promised the children and the others, who gave him the complaints, that he will proceed against all these people (Muralidharan, Chittibabu, Kingston, Annapoorna, Nirmala) legally. But later out of some mysterious circumstances he showed no interest any more.
Everyone, who complained to him to take legal action, said that some kind of a deal must have happened between Prabhu and Muralidharan.
That was a very bitter experience for all of them, which made them lose trust.
But Durga courageously searched further to get justice. She approached the former Sevalaya donor Yoga- Vereinigung Rajagopalan e. V.(YVR), S. Rajagopalan and Jan-Uwe Burmeister, Germany, who had made building the auditorium and three classrooms for science labs with equipment(including the physics-lab) possible in 2000.Auditorium with three science labs donated by YVR in 2000
How painful it must be for a donor when a girl gets sexually abused in that building, which he had sponsored for children to enjoy their education?!

Since S.Rajagopalan and Jan-Uwe Burmeister were not residing and not present in Chennai, they got the advice from another NGO in Chennai to send Durga and all other complainants to ICCW (the Indian Council of Child Welfare in Chennai). Four human rights organisations (HRO) including ICCW and its advocates interviewed Durga and all the complainants on the 8th of January 2008. Bhuvaneshwari the wife of Muralidharan (honorary correspondent of Sevalaya) and Muralidharan's father in law T.S. Venkataramani (honorary co-cordinator) participated in the investigation conducted by ICCW.

Muralidharan became desperate not being able to suppress the truth. He defamed and humiliated Durga, the witness to the sexual abuse, Miss Adi Lakshmi and also every complainant including the German donor YVR falsely accusing all of them of crimes against Muralidharan and Sevalaya. But the written answer from ICCW and the other HRO was very clear (see 'Durga Child Abuse Case', 'ICCW'): they had no doubt that the reported sexual abuse and other irresponsible incidents had happened in Sevalaya.
ICCW called it unfortunate, that Sevalaya's understanding of child abuse is superficial. They also wrote that certain behaviour of Sevalaya would appear as part of deliberate plan to mislead the general public.
Muralidharan's desperation started growing. Meanwhile the media took interest in the sexual abuse of the girl Durga. Chennai based SunTV-news, the most popular, powerful and trusted news-television-channel did its own investigation. When they wanted to interview him regarding this sexual abuse,
Muralidharan refused for the interview.
Muralidharan tried to influence SunTV not to air their investigation about Sevalaya's sexual abuse. But thanks to the very courageous reporter, SunTV-news repeatedly broadcasted his investigation-report from 22.12.2007 in the night breaking-news onwards. It is said that Muralidharan is still giving problems to that reporter and trying to destroy his career like he was doing with many other people who crossed him.
Also a reporter of the newspaper Indian Express in Chennai investigated into the sexual abuse against Durgha. He also had a look into the videotaped documentation of Prabhu. An article about the sexual abuse against Durgha was published in Indian Express on 02.01.2008 (see 'Durgha Sexual Abuse Case', 'Press/TV Dec. 2007/ Jan. 2008'). Other newspapers also reported about the sexual abuse of Durga in Sevalaya. After a thorough investigation India's most respected and most widely seen broadcasting channel ND-TV on 09.01.2008 gave also repeatedly a detailed report of this case in the breaking news.(see 'Durga Sexual Abuse Case', 'Press/TV Dec. 2007/ Jan. 2008').On 23.01.2008 Durga appeared even in the Chennai public hearing of NCPCR (National Commission for the Protection of Child Rights) presided by its chairperson Prof. Santha Sinha from Delhi. According to the newspaper reports following this hearing
NCPCR said that they have many complaints related to Sevalaya.
And Prof. Sinha came down heavily on the Department of School Education and the state police, for not holding proper investigations into the issues where children were victims.Out of - how Prof. Sinha called it - dismay NCPCR even sent on 04. Febr. 2008 a letter to the Minister of School Education of the former Government of Tamil Nadu, Mr. Thangam Thennarasu, to present few recommandations for further actions. The Commission expressed also its impression from the public hearing that in Tamil Nadu
'there is a greater emphasis on protecting institutions over protecting children'
(see 'Politicians/Police/Officials/Others', 'Invitations' and also 'Durgha Sexual Abuse Case', 'NCPCR').All these reports made Muralidharan more desperate. End of January 2008 he put a defamation case against SunTV, Indian Express and other media and also against his former German donor YOGA-VEREINIGUNG RAJAGOPALAN e.V., S. Rajagopalan and Jan-Uwe Burmeister, accusing and defaming all of them widely.
By manipulating the Court Muralidharan got a non bailable arrest warrant against Jan-Uwe Burmeister in June 2008.
But it was immediately cancelled by the same judge on 08.07.2008 when he was presented the fact that Muralidharan has lied to the Saidapet Court. The Press reported about it (see 'Case against Donors/Media').The German donor, S. Rajagopalan and Jan-Uwe Burmeister went against Muralidharan's defamation case; Chennai High Court gave first Dispense and Interim Stay Orders on 21. July 2008 and squashed the case completely on 09. July 2010 - the Court did not find any trace of defamation in Muralidharan's defamation case against all of them including the media (regarding all that see 'Case against donors/media').
After the sexual abuse Durga had tried to register a case at Vengal Police Station. Its officers constantly appeared at Sevalaya's functions and showed themselves very close to Muralidharan (see 'Politicians/Police/Officials/Others'). So it seemed no surprise that they refused to register the First Information Report (FIR). Instead they accused her and the other complainants for making false complaints. When she went again in July 2008 they refused again. On 14.07.2008 Durga with the help of dedicated and determined Chennai High Court Advocate Mr. Shreedhar approached the local Thiruvallur Court. It passed an order on 11.08.2008 to the Inspector of Vengal Police Station for registration of the case and necessary investigation to report within 4 weeks.
Only on 01.09.2008 the Vengal Police Station registered the FIR, but closed the case 24 hours later because of 'mistake of facts'. Nobody could understand how this can happen violating all rules. Advocate Shreedhar approached the High Court in Chennai and got an order in November 2008 to transfer the investigation to CB CID (Crime Branch Criminal Investigation Department) in Chennai for proper, effective and fair investigation. Meanwhile the media were more and more interested to follow up the case and reported about it on 18.12.2008 (see 'Durga Sexual Abuse Case', 'Court/Press Dec. 2008').
During CB CID-investigation Palanisami got married. Very soon his wife got pregnant. Locals around Sevalaya were telling that Muralidharan had arranged that marriage to save his and Sevalaya's name and fame. He was desperately trying to create a different image of Palanisami, so that CB CID will have mercy with him, his wife and the coming baby.
But again all that failed. In May 2009 CB CID delivered their final report after a thorough investigation including 24 witnesses and informed about that on their website (see 'Durga Sexual Abuse Case', 'CB CID/Press').
The result of CB CID was:'Investigation by CB CID has clearly established, that Tr. Palanisami, Physics Teacher, Aged 30, S/o Govindasamy, Periyamarai, Sullagudi Post, Perambelur District, had abused Selvi Durga Devi sexually in the Physics Laboratory of the school'.
Consequently CB CID arrested Palanisami.
The media again took widely notice and reported about it (see 'Durga Sexual Abuse Case', 'CB CID/Press May 2009').Only now Muralidharan suspended Palanisami - nearly 3 years after he committed the crime.
Since Muralidharan kept his attitude only to care for his name and fame he became more and more desperate. The Palanisami trial started at the local Thiruvallur Magistrate Court. Right from the beginning the case went very slow because of constant delaying tactics.
At the same time Muralidharan was very fearful that Durga and others would talk again to the media, because his above mentioned defamation case against media and the former German donor was squashed by Chennai High Court in July 2010. So he started in September of 2010 to send regular lawyer-notices to Durga, her mother, Adi Lakshmi, advocate Shreedhar, S. Rajagopalan and Jan-Uwe Burmeister, to restrain them from talking to any media and any person. He said that he even had put a civil case against all of them in the Thiruvallur Court.
When Muralidharan realized that his newly attempt also was not able to intimidate Durga and the others, his desperation reached a new height. He put a criminal defamation case against Durga, her mother, Adi Lakshmi and advocate Shreedhar using the same old tactic to defame all of them in the light of the clear result of CB CID.
In spite of all further delays and intimidations regarding the trial against Palanisami, which in total required seven approaches of the Chennai High Court by advocate Shreeedhar, Palanisami was convicted on 11.12.2012 to 2 years rigorous imprisonment and a fine of Rupees 10.000. In its judgement the Court dealt very carefully, precisely and exhaustively with every argument and every statement of the 24 witnesses and also with all the arguments of Sevalaya's Palanisami.It is really worth to quote some parts of this landmark judgement for justice and also future protection of children.
The final conclusion of the Court is:
'To sum up, the prosecution has successfully established that the accused indulged in indecent affront to the sexual modesty of the victim in a public place, thereby committing an offence punishable under ….'(page 38)
.About Muralidharan the Court writes under 'Genesis of the case':'It is evident that the victim later reported about this matter to the correspondent Muralidharan, who used to pay visit to the school on every Sunday. He is said to have advised the victim not to divulge about this incident and to concentrate on studies'(page 25).
The Court also writes:'We are not concerned about the other illegalities in the school although it may be incidentally relevant'(page 30).
'This clearly portrays the vindictive action that the school administration has taken against students who went against the institution or who raised voice against the institution. Hence this contention also fails and it is for the appropriate authorities to look into this sort of activities by school managements'(page 37).
Like Muralidharan did desperately even in public and also worldwide, Palanisami also defended himself by saying that Durga and her family were bought by the German donor, to tell this story which in reality never happened. The Court did not find any fact or evidence which supported this defence and said:
'For the abovementioned reasons this court is unable to sustain the contention of the learned defence counsel that the entire prosecution is at the behest of the erstwhile donor Rajagopalan'(page 31)
.And with clear common sense the Court said also:'… it is unbelievable that such tenderly aged girls would've mustered their guts to adduce false evidence in public court about indecent behaviour meted out to them shaking their own dignity'(page 31)

Muralidharan in his desperation and cunningness hided all this and did not even say one word. Until today he never informed the public and his donors about corporal punishment, child sexual abuse, suicide and death of Sevalaya-children out of carelessness, a murder case in the Sevalaya's old age home (one of its old men was killed by another, who was sentenced to life imprisonment in March 2013; see 'Murder Case') and other irresponsible incidents inside Sevalaya in all his regular letters and e-mails to friends and donors in India and also worldwide, in his monthly published 4-pages-'Sevalaya Newsletter', in his yearly published annual reports, on his website, on his social media like facebook or in his videos on You Tube.
Defending the perpetrator and defaming the victim and others, who want justice, denying the crime of child sexual abuse in one's own institution even after police and Court are convinced - that attitude leads insiders normally to the conclusion that such case is only the tip of an iceberg; there could be much more of such cases, which the management of an institution is deliberately hiding.
Experts expressed already in public this concern regarding Muralidharan and Sevalaya. That would unfortunately fit to reports from locals around Sevalaya. End of 2000 the last remaining co-founder of Sevalaya, the headmaster Thangaraj, was pushed out by Muralidharan. He deliberately and falsely accused Thangaraj of creating caste problems in Sevalaya and also of wanting to take over Sevalaya by planning to kill Muralidharan (with the latter l he is also still defaming the German donor).

Locals, who have great respect for Thangaraj, are telling that after Thangaraj was forced by Muralidharan to leave Sevalaya, one girl in Sevalaya was sexually abused falling short of rape by present headmaster Kingston. The girl tried to commit suicide by swallowing poison since she was deeply afraid to be pregnant by Kingston. For three days Kingston locked himself in his room, because he was terrified that the girl could die, but she survived. Everyone in Sevalaya, the staff and the teachers, who were there at that time, knew about it but nobody including the victim had the courage to come forward to let the public know about this case because of Muralidharan's threats.
Later Kingston climbed up in Sevalaya: as assistant headmaster, as the head of the Vivekananda Team being in charge of the girls and boys hostel (which raised deep concerncs in many people), as head of the department 'Computer Science' and finally even as the headmaster of the school after the then headmaster Chittibabu left in 2012. People around Sevalaya, who are sending their children to Sevalaya, are saying that all children had a lot of fear of Kingston using again and again violent corporal punishment. It is said that about this even volunteers who worked in Sevalaya in the year 2005/2006 reported to Muralidharan but again he failed to take any action. All this is supporting unfortunately the concern that the crime against Durga is only the tip of an iceberg.
If so, one can only wish that former victims will soon get the courage to speak out and demand justice from the institution and its managing trustee Muralidharan. Not only the present growing sensitiveness and anger of the Indian general public and the changing attitude regarding such crimes against girls and women is making it easier for former and may be future victims.Also the 'protecting shield', which Muralidharan built up around the institution from 2006 onward, is said not to be there anymore. Because of Durga's growing courage and persistency also Muralidharan's desperation and arrogance grew.
It appears as if he misled and manipulated cleverly many politicians and police officers especially from the local Vengal Police Station by only showing the shining 'image-part' of the institution, but hiding the rest. He was even able to pull Local, State and Central Ministers into Sevalaya - and also high ranking police officers like former Director General of Police in Chennai, Mr. R. Nataraj, who is still a member of Sevalaya's advisory board. According to Muralidharan's own newsletters they are hardly appearing anymore in Sevalaya.
And the question remains: how many out of the more than 30 Awards, which Muralidharan managed to collect since 2006 from different organisations (see 'Awards', 'Sevalaya List'), he would have got if the tip of the iceberg and the possible iceberg would have been known to them?
